Harmful product cases are common in tort litigation.  As a consumer-based society, there is a significant occurrence of harmful products.  Goods and services are exchanged every second of everyday.  Furthermore, the broad span and wide variety of products supplied to the consumer provides for ample opportunity for a negligent action to injure a consumer.

Companies are urged to ensure the safety of the consumer through extensive product testing, crash tests, stress tests and environmental impact tests.  Despite the best efforts of the government agencies that struggle to protect the customer, products enter the market that can be tremendously harmful and have life altering side effects.

There are six regulatory agencies that oversee product safety.  The government regulatory commissions that supervise product safety and product recalls are:

• The U.S. Consumer Product Safety Commission (CPSC)
• The National Highway Traffic Safety Administration (NHTSA)
• The U.S. Coast Guard (USCG)
• The Food and Drug Administration (FDA)
• The Food Safety and Inspection Service (FSIS)
• The Environmental Protection Agency (EPA)

The issue that compounds the product safety issue is the wide variety of consumer products that exist.  The government has tried to organize all products into seven different categories.  The categories for potential harmful products are provided below along with the abbreviation of the regulatory commission that supervises that area of safety:

• Motor Vehicles (NHTSA)
• Boats (USCG)
• Food (FDA) & (USDA)
• Medicine (FDA)
• Cosmetic Products (FDA)
• Environmental Products (EPA)
